1. About Echo
Echo Sound & Culture is operated by Crystal Clark as a sole proprietorship. In these terms, “Echo,” “we,” “us” and “our” refer to Crystal Clark carrying on business as Echo Sound & Culture. These terms apply to purchases made through our website, www.echosoundculture.com, and your use of that website, including when you reach it through Google or another referral service. Purchases completed on another marketplace are also subject to that marketplace’s applicable terms.
Our store is hosted on Shopify, which provides the ecommerce platform. Echo is the seller of the products you purchase from this store.
2. Shopping with us
You must have legal capacity to enter into a purchase agreement, or act with appropriate authorization from a parent or guardian. Please provide accurate contact, payment and delivery information and use only payment methods you are authorized to use. Keep your account credentials secure and contact us if you suspect unauthorized activity.
The product listing, order details and policies presented before purchase form part of your purchase agreement. The Return & Refund Policy governs voluntary return procedures; the Shipping Policy governs delivery arrangements; and the Privacy Policy explains personal-information practices. If a store policy conflicts with these terms concerning mandatory consumer protections, the protection required by law applies. Nothing in these terms removes consumer rights that cannot legally be excluded or limited.
3. Vintage items, records and product descriptions
Our collection includes vinyl records, music and media, vintage clothing, décor, collectibles and original works. Many items are pre-owned or one of a kind. Their age, condition and any disclosed wear are part of the individual listing and should be considered before purchase.
Please review photographs, measurements, grading and condition notes. Record and sleeve condition may differ; refer to the grades stated in the listing. Where a listing supplies a single condition grade for a record and its sleeve, that grade applies to both unless the listing states otherwise. Playback testing is included only where expressly stated. A sealed record has not been opened for inspection or playback testing, and sealed does not necessarily mean that its sleeve is flawless.
Colours may vary slightly between screens. Vintage garment sizes may differ from modern sizing; use the listed measurements when available. Ask us about any important detail that is unclear before ordering. These explanations do not excuse inaccurate descriptions or limit remedies for faulty or misdescribed goods.
4. Prices, payment and availability
The currency applicable to your purchase is shown at checkout. Applicable taxes, delivery charges and any other charges collected by us are disclosed before you submit your order. Your payment provider may apply its own currency conversion or transaction charges.
Payment is processed using the methods offered at checkout. Many items are available in limited quantities. Placing an item in your cart does not reserve it.
An automated order acknowledgement confirms receipt of your order. We accept your order when we send a dispatch confirmation or another express acceptance, subject to applicable law. We may decline an order before acceptance for an inventory error, payment failure, suspected fraud or inability to deliver to the requested destination. If we cannot fulfil an order for which payment has been collected, we will notify you and refund the unfulfilled portion and associated charges to the original payment method.
If a material pricing or description error is discovered, we will contact you to resolve it. We will not increase the amount charged or substitute a different product without your agreement. Rights relating to an already accepted order remain subject to applicable law.
5. Order changes and cancellation
Contact us promptly if you need to change or cancel an order. We will review your request against the order’s processing status and the cancellation terms disclosed before purchase. We may be unable to accommodate an address change or voluntary cancellation after dispatch. Statutory cancellation and withdrawal rights are unaffected by any voluntary cancellation deadline.
6. Shipping and delivery
Available destinations, shipping services, charges and delivery information are presented on our website or at checkout. Any published Shipping Policy forms part of your order terms. Carrier delivery estimates are estimates unless expressly guaranteed. Delays may arise from customs processing, weather or carrier disruption, but this does not remove your legal rights if delivery is late or does not occur.
Please check the delivery address carefully. If a parcel is lost, damaged or incorrectly delivered, contact us so we can investigate with the carrier and arrange the remedy required by your order terms and applicable law. We do not treat handing a parcel to a carrier as an automatic release from our obligations to you.
International orders may attract import duties, taxes or carrier clearance charges. Charges not collected at checkout may be payable by the recipient where disclosed and legally permitted. We do not understate customs values or mark commercial purchases as gifts.
7. Returns, refunds and problems with an order

If an item arrives damaged, incorrect or materially different from its description, contact us promptly with your order number and details. Photographs of the item and packaging can help us investigate. Keep packaging where reasonably possible. These requests do not remove your statutory rights or create an additional legal deadline.
Mandatory consumer law takes priority over conflicting provisions in these terms or another store policy. We will not impose a restocking fee, final-sale restriction or return condition where prohibited by law. Remedies for defective or misdescribed goods remain available even where a change-of-mind return exclusion applies.
Where EU statutory withdrawal rights apply, eligible customers generally have 14 days after delivery to notify us of withdrawal and a further 14 days after that notification to send the goods back. We will reimburse payments without undue delay and within 14 days after receiving a valid withdrawal notice, including standard outbound delivery costs where required. We may withhold reimbursement until we receive the goods or evidence that they have been sent back, whichever occurs first, where the law permits. Refunds use the original payment method unless another method is expressly agreed without additional cost to you. No restocking fee applies to a statutory withdrawal. Direct return costs are payable by the customer only where lawfully disclosed in advance. Permitted exceptions may apply to genuinely personalized goods and sealed audio or video recordings unsealed after delivery. Those exceptions do not eliminate rights concerning faulty or misdescribed goods. Other mandatory rights, including those applicable in the UK or your place of residence, are preserved.
8. Custom orders
For any custom or personalized order, the agreed specifications, price, payment schedule, estimated completion date and cancellation terms will be confirmed before work begins. Changes may affect price or timing and require mutual agreement. Any change-of-mind return exclusion will be disclosed before purchase and applies only where lawful.
9. Website content and acceptable use
Our original photographs, written content and branding are protected by applicable intellectual property law. Product artwork, artist names, trademarks and other third-party material remain the property of their respective owners. Buying a physical item does not transfer reproduction or commercial-use rights unless expressly agreed in writing.
Do not use the website for fraud, unlawful activity, malware distribution, unauthorized access or infringement of another person’s rights. We may restrict access reasonably necessary to prevent misuse, without affecting existing purchase obligations or mandatory customer remedies.

Shopify, payment providers and linked third-party services may have their own terms and privacy notices. Links to external sites do not mean we control their content. These terms do not constitute consent to marketing messages; any required marketing consent is obtained separately.
11. Responsibility and consumer protections
We take reasonable care to keep our website accurate and available, but cannot promise uninterrupted access or that every technical error will be prevented. Any interruption does not remove our obligations for accepted orders.
Nothing in these terms excludes liability for fraud, wilful misconduct, or any liability, warranty, guarantee or remedy that applicable law does not allow us to exclude. Describing an item as vintage, used or sealed does not override those protections.
12. Applicable law and disputes
Subject to mandatory consumer protections, these terms are governed by the laws of Manitoba, Canada, and the federal laws of Canada applicable there. You retain any mandatory protections and rights to bring a claim in your local courts that apply under the law of your place of residence.
Please contact us first if a concern arises so we can try to resolve it. This does not prevent you from contacting a consumer authority, using a payment dispute process or pursuing any legal remedy.
13. Changes and severability
We may update these terms for future transactions by publishing a revised version with a new effective date. The version applicable when you placed your order continues to govern that purchase unless you agree otherwise or law requires a change. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
